Procedures

 

Assessors Office

 

Lot Split:

 

  1. Survey of property to be split showing locations of any structures and easements on property.  The survey or map must show:

 

(a)     Boundaries (as of March 31, 1997), and

(b)    all previous divisions made after March 31, 1997, indicate when made or none, and

(c)     the proposed division(s)

(d)    dimensions of the proposed divisions, and

(e)     existing and proposed road/easement right-of-way, and

(f)      easements for public utilities from each parcel to existing public utility facilities, and

(g)     any existing improvements (buildings, wells, septic system, driveways, etc.)

(h)     accessibility

(i)       municipal water services

 

  1. Survey of property after split showing locations of any remaining structures and easements.
  2. Lot Split or Land Division application must be completed and any applicable fees paid.

 

Land Division:

 

  1. Two surveys as listed above for lot split plus completion of application for land division.
  2. Requirements include accessibility of water and sewer (perk test).
  3. Neither change in property dimension indicates build ability of property.

 

Register of Deeds

 

All lot splits and land divisions must be recorded at the Register of Deeds Office, Berrien County Administration Center 3rd Floor, 701 Main Street, St. Joseph, MI 49085.

 

Clerks Office

 

  1. A receipt or copy of the recorded document must be presented to the Clerks office for issuance of a property address.
  2. If property is fronting on a proposed Private Road, a Private Road Application must be completed and any applicable fees paid.

 

Treasurers Office

 

  1. Sewer and/or water applications must be completed and proper fees paid for service, if applicable.
  2. Any special assessments may also be added at that time.

 

After all these steps are completed then a Zoning & Building permit may be obtained.  The Township and its officers shall not be liable if Zoning or Building permits are subsequently denied for the parcels because of inadequate water supply, inadequate sewage disposal facilities or otherwise.
