Supervisor Conway Opened the Public Hearing at 9:08 a.m.

All members present.

Supervisor Conway stated that the Public Hearing is at the request of Dominic Farina, Majority Property Owner in Golfmore II. The request is for a Special Assessment District to cover the yearly fees of the Licensing Agreement between Amtrak and the Township which Golfmore Estates, Inc. pays to have the Sewer facility go underneath the Amtrak RRX. The fees have been running approximately $700 per year and have increased each year by a few dollars. The assessment will be on going as long as there is a fee to be paid. If at some later date the sewer lines are extended on that side of the tracks and use the same facility under the tracks, then the assessment will be spread amongst those new users.

Approximate assessment per year is $30.00, no interest to be charged.

 

It should be noted that there was no one in the audience pro or con for the SAD.

 

Zabicki moved, Conway supported to close the Public Hearing at 9:15a.m.

 RESOLUTION NO. 2

 

Township of New Buffalo

County of Berrien, State of Michigan

           

Minutes of a regular meeting of the Township Board of the Township of New Buffalo, County of Berrien, State of Michigan, held in the Township Hall in said Township on the 31st day of October, 2003, at 9:00 a.m. Eastern Daylight Saving Time.

            The following preamble and resolution were offered by Member   Rahm   and supported by Member   Zabicki     :

 

            WHEREAS, the Township Board of the Township of New Buffalo, County of Berrien, State of Michigan, after due and legal notice, has reviewed a special assessment roll prepared for the purpose of spreading the of the cost of certain improvements as described in Exhibit A attached hereto and made a part hereof; and

 

            WHEREAS, the Township Board deems said special assessment roll to be fair and equitable as reported to it by the Supervisor;

 

            NOW, THEREFORE, BE IT RESOLVED THAT:

 

            1.         Said special assessment roll shall be designated “Golfmore II Estates Special Assessment Roll” and the district against which it is spread shall be designated “Golfmore Estates II Special Assessment District.”

 

            2.         Said Golfmore II Estates Special Assessment Roll, in the amount of $1,575.00, as prepared and reported to the Township Board by the Supervisor, be and the same hereby is confirmed for 2003 Tax Roll and the amount of $750.00 for the 2004 & subsequent rolls.

 

            3.         Said special assessment roll shall be due on December 1st, 2003, and the following installments to be due on March 1 of each and every year thereafter.  Said special assessment roll shall not be charged interest. Said special assessment roll shall continue as long as the Amtrak Licensing Agreement is in place and further shall be adjusted annually as needed for the increase in the Licensing Fee.

            4.         The assessments made in said special assessment roll are hereby ordered and directed to be collected, and the Township Clerk shall deliver said special assessment roll to the Township Treasurer, with the Township Clerk’s warrant attached, commanding the Treasurer to collect the assessments therein in accordance with the directions of the Township Board with respect thereto, and the Treasurer is directed to collect the amounts assessed as the same become due.

 Zabicki moved, Rahm seconded to authorize payment for the Skate Park lease purchase agreement to 5th  Third Bank. $976.47 to come from the skate park account with the remainder to come from the Clerks Wage account.

Zabicki moved, Conway seconded to hire Ed Wainwright as the Township Plumbing inspector @ $35 dollars per hour. All training and registration fees to be paid by the inspector.

Steinke moved, Rahm seconded to adjourn. Time 9:20 am.
