Supervisor Conway Opened the Public Hearing at 9:05 a.m.

Supervisor Conway stated that the Public Hearing is at the request of Dominic Farina, Majority Property Owner in Golfmore II. The request is for a Special Assessment District to cover the yearly fees of the Licensing Agreement between Amtrak and the Township which Golfmore Estates, Inc. pays to have the Sewer facility go underneath the Amtrak RRX. The fees have been running approximately $700 per year and have increased each year by a few dollars. The assessment will be on going as long as there is a fee to be paid. If at some later date the sewer lines are extended on that side of the tracks and use the same facility under the tracks, then the assessment will be spread amongst those new users.

Approximate assessment per year is $30.00, no interest to be charged.

 

It should be noted that there was no one in the audience pro or con for the SAD.

 

Zabicki moved, Conway supported to close the Public Hearing at 9:10a.m.

RESOLUTION NO. 1

 

Township of New Buffalo

County of Berrien, State of Michigan

 

Minutes of a special meeting of the Township Board of the Township of New Buffalo, County of Berrien, State of Michigan, held in the Township Hall in said Township on October 3rd, 2003, at 9:00 o’clock a.m., Eastern Daylight Saving Time.

 

PRESENT:       Conway, Zabicki, Braden & Rahm

ABSENT:        Steinke

 

            The following preamble and resolution were offered by Member ­­­­­­­­­­­­­­Zabicki and supported by Member _Conway___:

 

            WHEREAS, the Township Board of the Township of New Buffalo, County of Berrien, State of Michigan, pursuant of Act 188, Public Acts of Michigan, 1954, as amended, tentatively declares its intention to undertake certain public improvements as described:

 Licensing Agreement for the Extension of Sewer Facility underneath Amtrak to serve Golfmore Estates II.   Licensing fee is assessed yearly. The special assessment district tentatively designated and described here;

            WHEREAS, the Township Board desires to proceed with the proposed public improvements;

 

            NOW, THEREFORE BE IT RESOLVED THAT:

 

            1.         The New Buffalo Township Clerk is hereby are ordered to prepare costs of the license agreement with Amtrak and properties involved.

                         2.        All resolutions and parts of resolutions insofar as they conflict with the provisions of this resolution be and the same hereby are rescinded.

RESOLUTION DECLARED ADOPTED.

 

Conway moved, Zabicki supported to place an ad in the News Paper for an

assistant Zoning Administrator and a Fire Inspector.

 

            Motion             Carried                                                

Conway moved, Braden supported to authorize the Clerk to have the Township

Attorney develop and Recommend the Fire Inspection Ordinance.

Rahm moved, Braden seconded to adjourn at 9:11 am.

Friday October 17th, 2003 @ 9:00 a.m.
